A friend used my debit card for car repairs and won't pay me back.?
A friend out of town asked if he could use my debit mastercard for some emergency car repairs. He said it would be about $800 and he promised he would pay it back in a few days when he sold the car (a BMW) to his brother. I gave him the card #. It ended up being $2,000 when the amont was deducted from my checking account. It is months later and he hasn't sold the car, hasn't paid me any money and now won't return my phone calls. I technically did not authroize use of my debit card for the transaction and I did not want to get him in trouble with the law. Is it too late to do anyt hing to get my money back?

Mark Atland:  If he used your debit card PIN number you're screwed. But if he used it as a credit card you can dispute the charges with your bank.

aw03172001:  You need to document the times you've called him. You will need this when you file on small claims court. You can actually file up to $5,000.00 on small claims (this is the maximum). You can claim your phone bills, the time you took off work to file for the claim, the mental anguish for not being able to replinish your savings, etc. Third step, let this be a lesson for you....don't let friends "borrow" money because this could lead to amnesia.

meow:  You could take his to small claims, he wouldn't go to jail, you would just be suing him for the $2,000. But I am not sure if the judge will judge in your favor since you did authorize him to use your debit card, do you have anything in writing that says he'd pay you back? If not you might be SOL, but its worth fighting for in court.

Sbrown:  this is the biggest lesson for all of us never ever give CC / debit card details to any tom, dick and harry...........this guy is not even one of them.your own friend........consult a lawyer
